Discuss a case in which a defense attorney argued that due to some impairment their client was not capable of freely choosing to commit the crime.

The notion that a defendant effectively lacked free will when he or she committed a crime has been used (with varying degrees of success) as a legal defense in criminal cases. For example, defense attorneys have argued that due to impairment by “affluenza”; temporary insanity; or sugary foods–the so-called “Twinkie defense”–their client deserves to be acquitted or charged with a lesser crime. Discuss a case in which a defense attorney argued that due to some impairment their client was not capable of freely choosing to commit the crime. Do you agree that the defendant acted without free choice? Explain why or why not. If so, how should that affect their punishment?

Do you think you have free will? Explain why or why not. Demonstrate your understanding of concepts we have studying in answering the question.

Task: Identify a social issue that you believe we are facing today in Kuwait. After doing some research about the topic, prepare an outline for an informative speech. Once that has been approved by me, record the speech on your phone and upload to Moodle.

Provide your audience with a clear understanding of how and why this is a social issue in Kuwait and why it needs to be addressed. Educate your audience on this issue through informal and formal evidence of facts, i.e., through observation, or statistics or facts based on more formal research. Follow up with the consequences of the social issue, either at this time or if not addressed. You may also want to give some preliminary ideas of what steps can be taken to fix or alleviate the issue.

You are encouraged to fulfill the assignment with creativity, reflection and critical thinking. Making meaningful connections to the textbook is highly recommended. For example, many social issues are a result of a logical fallacy, and higher leveling thinking could be a possible solution. Additionally, social issues may result from lack of social spatial awareness or lack of open-mindedness. Therefore, educating others on a more liberal way of thinking or having multiple perspectives could be a possible solution.
