Do you believe that the jury’s award of $2.7 millions for third-degree burns was excessive? Why do you believe that such an award is necessary?

Stella Liebeck, an elderly grandmother, received third-degree burns when she spilled coffee purchased at a McDonald’s drive-through. At trial, experts testified that McDonald’s coffee was too hot to be consumed at the point of purchase, was hotter than any other restaurant’s coffee or coffee brewed at home, and was so hot that third-degree burns would result within three to five seconds of coming into contact with the skin. McDonald’s also conceded that the coffee was brewed extremely hot for commercial (profit) reasons, because most customers wanted coffee to be hot throughout their commute. After finding the company liable, the jury awarded Mrs. Liebeck two days’ worth of coffee sales at McDonald’s, an amount equivalent to $2.7 million, in punitive damages. The award, although reduced to much less than that, set off a firestorm of criticism that has not died down to this day. Do you believe that it’s possible for coffee to be unreasonably dangerous? See http://www.hotcoffeethemovie.com for one filmmaker’s perspective on this case.

Do you believe that the jury’s award of $2.7 millions for third-degree burns was excessive?  Why do you believe that such an award is necessary?  Can you identify any standards which have changed in the industry based upon this case?

Compare and contrast the most and least committed persons at your present employer. How does their level of commitment impact their productivity?

Remember, that the purpose of this discussion is not to answer my initial or follow-up questions. The purpose is to engage with the assigned readings and integrate them with other ideas and into your daily (or future) practice. Please do use terminology from the assigned readings, cite the textbook with at least an in-text citation (Dipboye, 2016), and bring in current events (provide a URL) to add to the conversation and to support your points. Write a short essay defending Cansco. Cite to your supporting cases by comparing and contrasting the similarities and/or differences between those cases and Cansco’s case.

A water pipe burst in the basement of Superfast, a grocery store, flooding the basement and damaging cases of canned goods on the floor. The plumbing contractor’s workmen, in repairing the leak, knocked over several stacks of canned goods in cases, denting the cans. After cleaning up, Superfast put the goods on special sale.

Four weeks later Susan was shopping in Superfast. Several tables in the market were covered with assorted canned goods, all of which were dirty and dented. A sign on each of the tables read: “Damaged Cans – Half Price.”

Susan was having Guest for dinner that evening and purchased dented two cans of chicken, packed by Cansco, from one of the tables displaying the damaged cans. Before Guest arrived, Susan prepared a chicken pot pie which she and Guest ate. Both became ill and the medical testimony established that the illness was caused by the chicken being unfit for human consumption. The cans of chicken consumed by Susan and Guest came from the case that was at the top of one of the stacks knocked over by the workmen.

Susan asserts a claim against Cansco based on negligence, what results? Although Guest may have a case against Superfast, and the plumbing workmen may have some responsibility, you are only to discuss Susan’s claim against Cansco. What are the defenses which Cansco may raise?

Find three cases that support Cansco’s defense in this case. Write a short essay defending Cansco. Cite to your supporting cases by comparing and contrasting the similarities and/or differences between those cases and Cansco’s case.

List some things that help keep you focused as a reader. What are some things that usually make you lose focus or interest in a message?

Readability sounds like a fairly subjective term. What are some of the guidelines offered in the text to help readability? Now think about things that you read at work, or in your academic life. List some things that help keep you focused as a reader. What are some things that usually make you lose focus or interest in a message?

Refrain from sharing personal opinions, experiences. Write the case in the third person and provide an objective analysis based on your research and understanding of best practices in marketing.

  • Cases are used as studies in marketing, so applying marketing theory is the key to excellence in case analysis.
  • Since you may not be an expert in marketing, you will have to seek out information to help you interpret the case through the lens of a marketing expert.
  • Scholarly research – recommend 2-3 sources related to the marketing topics featured in the case (words in bold type). This information should be incorporated into your analysis to support/expand your analysis. Marketing101.com is not an example of an acceptable source.  “Do additional market research” is not an acceptable answer to case questions. This is an important point. If a case asks for strategy ideas to improve the protagonist’s prospects, make sure one of the strategies is not conduct market research. Marketing managers must often do not have time to conduct additional research and must make decisions on the information at hand – this is your task as well.
  • Address the marketing terms in your answers. Research what they mean and use that research to assess the case. Apply the research findings to your case analysis. Refrain from providing the definition of the term. Assume that the instructor knows the terms and what they mean.
  • Provide original ideas, thoughts and perspectives. Analyze. It is not necessary to do “set-up” by citing information from the case. Assume that the instructor has read it (many times) and will understand what you are analyzing.
  • Refrain from sharing personal opinions, experiences. Write the case in the third person and provide an objective analysis based on your research and understanding of best practices in marketing. This will enhance the veracity of your positions.
  • Do not include definitions of basic marketing terms and theory. Assume the reader knows what they mean.

Discuss the influence of any Federal government or state government programs, such as tax credits or tax deductions for energy-saving/efficiency purchases, on your decision to make your last big purchase; or if government incentives did not factor into your decision, explain why not.

Consider your last big purchase such as a car, appliances, home repairs, home purchase, computer equipment, college tuition, or another “big-ticket” item, which are often purchased using loans/financing (by borrowing money). Also consider your decision-making process that led you to choose a particular make, model, or brand of the product (or service) you purchased and whether it was the right time to make the purchase given economic conditions at the time of your purchase. While analyzing your decision, keep in mind everything from interest rates to the prices of complementary and substitute goods are driven by human economic behavior.

Develop an analysis of your decision-making process in which you include the following:

  • Retrieve statistics on Real Gross Domestic Product (GDP) and on Real Personal Consumption Expenditures (PCE) by year for the last ten years. You can retrieve those statistics from internet sources including, but not limited to, the Federal Reserve of St. Louis’s FRED web site, the U.S. Department of Commerce’s Bureau of Economic Analysis (BEA) web site, or another credible source of your choice. Post these statistics in a single worksheet of an Excel® workbook and submit your Excel® file with your report. In your report, discuss the latest 10-year trends in both GDP and PCE. Also discuss how the trends in GDP compare with trends in PCE. You are encouraged to include graphs of these statistics in your report; you could create the graphs in Excel®and copy them into your report.
  • Retrieve statistics on the Effective Federal Funds Rate and on the Consumer Price Index: All Items Less Food and Energy by year for the last 30 years. You can retrieve those statistics from internet sources including, but not limited to, the Federal Reserve of St. Louis’s FRED web site, the U.S. Department of Labor’s Bureau of Labor Statistics (BLS) web site, or other credible sources of your choice. Post these statistics in a single worksheet of an Excel® workbook and submit your Excel® file with your report. In your report, discuss how the trends in the Effective Federal Funds Rate compare with trends in inflation. If you took out a loan to pay for your “big-ticket” purchase, what was the interest rate on your loan? Were interest rates rising or falling at that time?  Were interest rates relatively high or low at that time? You are also encouraged to include graphs of these statistics in your report.
  • Discuss the influence of any Federal government or state government programs, such as tax credits or tax deductions for energy-saving/efficiency purchases, on your decision to make your last big purchase; or if government incentives did not factor into your decision, explain why not.
  • Develop conclusions about the economy’s influence on personal and business decision-making relative to purchases of big-ticket items, investments, or other major purchases.

Compare and contrast the role of ethnographies and case studies in data collection

Articulate the importance and usefulness of focus groups

For the researcher, focus groups provide the opportunity to interview several people at once regarding a topic (Glesne, 2016). The researcher poses a question or questions to the group allowing for the group to express differing or similar viewpoints and opinions on the topic (Glesne, 2016). The ability to speak and listen to several people within the group in a series of focus groups saves time and possible travel (Glesne, 2016). A skilled group facilitator, asking appropriate questions to elicit responses and information from the group, provides a secure interaction between the group members, which is as important as the information offered (Glesne, 2016). If several focus groups are held, the group is more relaxed and comfortable in speaking about possible uncomfortable topics. Per Glesne (2016), the group interaction provides reflection, knowledge, and potential growth for the group members, ideally creating a closeness that allows for quieter members to also discuss the topic. Focus groups are particularly useful in action and evaluation research in which participants may know to each other or the facilitator, such as conducting a group in the workplace (Glesne, 2016).

Compare and contrast the role of ethnographies and case studies in data collection

The data collection timeframe for ethnographic studies tends to be lengthy, undertaken in a group’s natural setting in which the researcher immerses self in the culture, possibly living within the setting, to determine what information is necessary for data reporting (Qualitative Data Collection, n.d.). Ethnographies utilize the most frequent types of data collecting methods, interviewing, and observing (Glesne, 2016). Data is collected via probing questions and interviewing and allows the researcher to be guided by the participant in helping to understand the social world of the participant in his word (Qualitative Data Collection, n.d.). With the help of the participants, the researcher gains an understanding of the culture studied, and through data collection can potentially generate a completely new hypothesis (Qualitative Data Collection, n.d.).

Case studies also require a long-term commitment to gather data and focus on the setting of a situation to “explore processes and outcomes” (O’Leary, 2005, p. 150). Before data collection, the researcher must decide on the context within the case study as either intrinsic, instrumental, or collective (Qualitative Data Collection, n.d.). An intrinsic case study is to understand the “intriguing nature” of a study, and an instrumental case study emphasizes broader issues that stem from the case, and collective case studies utilize several cases (Qualitative Data Collection, n.d.). Since the case study is incredibly in-depth, as in ethnography, the research potentially creates a new hypothesis about a specific “phenomenon” (Qualitative Data Collection, n.d.). Furthermore, case studies are unique to ethnographies in that the data collection applies to an event, a singular case, episode, setting, or group (O’Leary, 2005). Case study data collection can be individualized, such as gender, an institution such as a school, a cultural group such as Italians, or an event such as 9/11. The goal of the researcher is to choose a case or cases based on interests (O’Leary, 2005).

All types of data collection are geared towards potentially helping the world understand a culture or situation. The Bible also seeks to provide knowledge to those who listen and read the word of God, “and he has filled him with the Spirit of God, with wisdom, with understanding, with knowledge and with all kinds of skills” (Exodus 35:31, New International Version).

List and describe all of the potential benefits (and costs) that Nationstate would realize from the establishment of an enterprisewide architecture as envisioned by Jane Denton?

Review chapter 10 of the course text.  In your own words, discuss the actions that could lead to the development of effective risk management capabilities.

McKeen, J. D., & Smith, H. A. (2015). IT strategy: Issues and practices (3rd ed.). Pearson.

Read the Nationstate Case Study on pages 160-164 in the textbook. Answer Discussion Questions 1-2 at the end of the Case Study.

1. List and describe all of the potential benefits (and costs) that Nationstate would realize from the establishment of an enterprisewide architecture as envisioned by Jane Denton?

2. Build a business case for Seamus O’Malley to present to the senior management team at Nationstate in order to get their buy-in. In addition to benefits and costs, the business case must answer the “what’s in it for me” question that the BU 3presidents all have.

Initial post will be graded on length, content, grammar and use of references. References should always be below each question as they are a different topic and not related in any way.
