Step 3. Case Study Analysis. You are a Federal Court of Appeals Judge and must decide in these 4 cases whether the defendant, who made incriminating statements, was in custody or not. Write a brief paragraph in each case supporting your decision with facts from the case.
Please follow these guidelines:
Attached are 4 federal Court of Appeals cases that challenged the definition of custody. The main goal is for you to figure out whether the defendants, who made incriminating statements, were technically in custody and therefore must be advised for their Miranda rights. As you read each case, look for attributes that would help you, the judge, determine whether the defendant was in custody. Some attributes to consider:
1. The method or language used by the police to summon the individual
2. Confrontation with police.
3. The physical surroundings at the time of the contact with the individual
4. The duration of the stop
5. The type of pressure applied by the police to keep the individual contained.
Some attributes to consider if you were the judge:
a. Custody does not mean arrest; the individual may be detained for a reasonable
amount of time until the investigations is completed
b. Would a reasonable prudent person, under the same circumstances, that they were
not free to leave.
c. Your decision will set a precedent and therefore the police should understand their
enforcement powers when it comes to situations like those in these court cases.
