Reply to Josephs response; I don’t know if you would call this an incident, but it is an ethical/legal issue that has actually come up a number of times in my career. I am a nurse and I work with the intellectually under-privileged community. Most of our patients are clearly not capable of refusing or consenting to treatment. In these cases, a representative of the patient consents to treatment. Some of our patients are clearly capable of consenting for their own treatment. But, occasionally, we have a patient who’s intellectual function is in the gray area. If a patient does not wish to proceed with treatment, but their mother, for example, wants us to proceed, we find ourselves in a very awkward position. If we opt not to treat the patient, some staff members feel that we have turned away a special needs patient, denying them the care they need. If we treat the patient, some staff members feel that we have treated a competent person against their wishes. I always opt for turning the patient away. In the event we turn them away, we ask them to undergo a psychiatric evaluation to determine if they are capable of comprehending the risks and the benefits of various medical treatments. I think this is both more ethical, and safer from a litigious standpoint. Unfortunately, I usually lose out on these discussions and we usually treat patients in situations like this. Reply to NIcholas’s response; The Financial Disaster of 2008 clearly was a financial nightmare for many Americans, some of which did not recover. There were several motivating factors that led to the disaster; however, it must be noted that the factors were not illegal, rather they were unethical. One of the factors that led to the disaster is that, at the time, borrowing money was cheap. Individuals borrowed more than they could afford and could not pay back as a result of historically low interest rates. Real Estate became the investment of choice, people borrowed money, took the equity out of their homes, and signed what was called liar loans. When the real estate bubble burst they owed more on their homes then it was worth. Wall Street also contributed to the financial disaster, what mattered most was short-term profits and short-term compensations of those making risky decisions. People who thought they were making responsible investments were misled. The ethical principles such as responsibility, transparency and fairness were violated during the Financial Disaster of 2008.
